Labor Code of the Philippines. The Labor Code of the Philippines is the legal code governing employment practices and labor relations in the Philippines. It was enacted through Presidential Decree No. 442 on Labor day, May 1, 1974, by President Ferdinand Marcos in the exercise of his then extant legislative powers. [1]
18 Jun 1949. The Civil Code governs private law in the Philippines, including obligations and contracts, succession, torts and damages, property. It was enacted in 1950. The prevailing labor code allows the typical working hour to be 8 hours a day, i.e. 48 hours a week with the provision that at least a day should be allowed to the workers as weekly off. [12] The right to self-organization of a union is recognized, as is the right of a union to strike and to insist on a closed shop.
The Labor Code failed, however, to include the terms and conditions of employment of children previously provided by R.A. 679, as amended by P.D. no. 148 creating a huge gap in the new law. This was eventually addressed through P.D. 603 or the Child and Youth Welfare Code, a codification of different provisions for the well-being of all children.
The Labor Code and other legislated labor laws are implemented primarily by government agencies, namely, Department of Labor and Employment and Philippine Overseas Employment Agency (now the country's Department of Migrant Workers). Non-government entities, such as the trade unions and employers, also play a role in the country's labor.
